If you subscribe to our services

If you become a subscriber to our services, you may choose to pay either monthly or annually. If you choose to pay monthly then your membership will continue until you or we terminate your membership on 30 days’ notice. If you choose to pay annually then your membership will expire one year after the start of your subscription unless you pay for a further year’s membership. Our subscription fees will be as advertised on our website. We may increase our fees from time to time. If you are a subscriber we will give you at least 30 days’ notice of any planned increases.

The additional content and services made available to our subscribers will be as advertised on our website from time to time.

We use third party payment processors

If you subscribe to our services we will take payment using third party payment processors. They have separate legal obligations in respect of how they use your personal data and payment details and we have no liability whatsoever for any breaches by them of any duties owed to you. For the avoidance of doubt, we will never have access to your bank account number, credit/debit card details or other payment information.

We may provide or withdraw additional free materials or services

We may provide additional free materials or services on our site from time to time. We may also provide trial versions of services normally provided only to our paying subscribers. Any such materials or services are provided solely at our discretion and may be withdrawn at any time.

Any user areas of our site are provided “as is”

We may provide the ability for paying subscribers to save lesson plans and other resources within their own user area of our site. We make no representation or warranty that these will be preserved and we will have no liability if any saved data is removed or if we withdraw this functionality.

We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell our subscription members in writing if this happens and we will ensure that the transfer will not affect their rights under the contract.

Our site is only for education providers in the UK

Our site is directed to education providers based in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations nor do we make our services available to consumers. If you are a consumer, you should not use our site and must not become a subscription member.

You must keep your account details safe

If you sign up for our subscription services, you must keep your user name and password confidential. You must not disclose them to any third party.

We have the right to disable your account if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user name or password, you must promptly notify us.

How you may use material on our site

These restrictions apply both to free material made available on our site and to other material that we make available only to our subscribers. They also apply to any dynamically-created content (including but not limited to lesson plans, activity cards and other education materials) that our site generates based on information you supply.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may use materials downloaded from our website solely for the purposes of your own business or school. You may make such reasonable copies as are required for the purposes of your own business or school. You must not make our materials or any copies available to any third parties. For the avoidance of doubt, where you are downloading subscriber-only materials for use within a school, you may not share those materials with other schools within the same local authority or education trust.

You must not modify any of our materials that you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

You may not place legal reliance on the content of our site

We do not guarantee that our site will be secure or free from bugs or viruses.

You may not use the names “Marvel Education”, “Marvel Sports Coaching” or “Marvel Primary” (or any other trading name or trade mark we use from time to time) without our approval, unless they are part of material you are using as permitted in these terms.
